Just Ate — Terms of Use (EULA)

1.Agreement to these terms

These Terms of Use ("Terms") are a legal agreement between you and Aleksandr Karpov, an individual developer based in Germany ("we", "us", "our"), governing your use of the Just Ate mobile application and related services ("Just Ate" or "the app").

By downloading, accessing, or using Just Ate, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

These Terms incorporate, and should be read together with, our Subscription Terms and our Health & Medical Disclaimer.

2.The Apple App Store (Licensed Application End User License Agreement)

Just Ate is licensed, not sold, to you. If you obtained the app through Apple's App Store, your license is subject to Apple's Licensed Application End User License Agreement (LAEULA) available at apple.com/legal/internet-services/itunes/dev/stdeula. To the extent these Terms conflict with the Apple LAEULA on matters Apple requires, the Apple LAEULA governs. You acknowledge that:

3.Eligibility

Just Ate is intended for users aged 13 and older. If you are under the age of majority where you live, you may use Just Ate only with the involvement and consent of a parent or legal guardian. By using the app you confirm you meet these requirements.

4.Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Provide accurate information and keep it up to date. Notify us at support@justateapp.com if you suspect unauthorised use of your account.

5.License and acceptable use

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Just Ate for your own personal, non-commercial nutrition tracking. You agree not to:

We may suspend or terminate your access if you materially breach these Terms.

6.Your content

You retain ownership of the content you submit (meal descriptions, photos, voice recordings). You grant us a limited, worldwide, royalty-free license to host, process, transmit, and display that content solely to operate and provide the app to you — including sending it to our AI and transcription providers to generate your nutrition estimates, as described in the Privacy Policy. This license ends when you delete the content or your account, subject to normal backup cycles.

You are responsible for your content and confirm you have the rights necessary to submit it.

7.AI-generated estimates and no medical advice

Just Ate uses artificial intelligence to estimate nutrition information from your text, voice, and photos. These estimates — including identified foods, portion sizes, calories, macronutrients, targets, and energy balance — are approximations and can be wrong.

Just Ate does not provide medical, nutritional, diagnostic, or treatment advice. It is an informational and organisational tool, not a medical device. Do not rely on it for medical decisions. Consult a qualified healthcare professional before making health, diet, or medical decisions, especially if you are pregnant or nursing, under 18, managing a medical condition, taking medication, or have a history of disordered eating. 8.Subscriptions and payments

Just Ate offers optional paid subscriptions that unlock additional features. Subscriptions are sold and billed through the Apple App Store, and Apple's terms and your Apple Account payment settings apply. Full details — pricing, free trials, auto-renewal, cancellation, and refunds — are in the Subscription Terms, which form part of these Terms.

9.Third-party services

The app relies on third-party services (including Apple, Google Firebase, Google Sign-In, and OpenAI). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services we do not control.

10.Intellectual property

Just Ate, including its software, design, branding, text, and graphics (excluding your content), is owned by us or our licensors and protected by intellectual-property laws. Except for the license in Section 5, no rights are granted to you. "Just Ate" and related logos are our marks and may not be used without permission.

11.Availability and changes to the app

We may modify, suspend, or discontinue any part of the app at any time. We may release updates that are required for continued use. We are not liable for any unavailability, data loss, or discontinuation, except as required by law.

12.Disclaimers

To the maximum extent permitted by law, the app is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or that estimates will be accurate. This section does not exclude or limit any statutory rights or warranties that cannot be excluded under the law of your country of residence (see Section 16).

13.Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the app. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the app is limited to the greater of (a) the amount you paid us for the app in the 12 months before the claim, or (b) EUR 50.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud, or for your non-excludable statutory consumer rights.

14.Indemnity

To the extent permitted by law, you agree to indemnify and hold us harmless from claims and expenses arising out of your misuse of the app or your breach of these Terms. This does not apply where prohibited by applicable consumer-protection law.

15.Termination

You may stop using the app and delete your account at any time from the Profile screen. We may suspend or terminate your access if you breach these Terms or where required by law. Sections that by their nature should survive termination (including Sections 6, 10, 12, 13, 14, and 16) will survive.

16.Governing law and your consumer rights

These Terms are governed by the laws of Germany, without regard to its conflict-of-law rules.

If you are a consumer resident in the EU, the UK, or another jurisdiction with mandatory consumer-protection laws, you benefit from the mandatory protections of the law of your country of residence, and nothing in these Terms deprives you of those rights, including your right to bring proceedings in your local courts. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

17.Changes to these Terms

We may update these Terms as the app evolves. We will update the "Last updated" date and, for material changes, provide reasonable notice in the app. Your continued use after changes take effect means you accept the revised Terms. If you do not agree, stop using the app and you may delete your account.
